Consent Form for Disclosure of Personal Data

For Use of Products or Transactions by Jadepay Co., Ltd.

Definitions

"I" refers to the individual using credit services or engaging in transactions with Jadepay Co., Ltd. by registering to request credit product services or financial transactions through electronic systems or other channels specified by Jadepay Co., Ltd.

"Company" refers to Jadepay Co., Ltd. and its future subsidiaries in which Jadepay Co., Ltd. is a shareholder.

"Personal Data" refers to any information relating to an identified or identifiable natural person, either directly or indirectly, excluding personal data of deceased individuals.

"Sensitive Personal Data" refers to personal data concerning race, ethnicity, political opinions, religious or philosophical beliefs, sexual behavior, criminal records, health data, disabilities, trade union membership, genetic data, biometric data (e.g., fingerprint or facial scans), or other data with similar impacts as defined by the Personal Data Protection Committee's regulations.

The Company collects, uses, and discloses your personal data for the following purposes:

• To assess and analyze credit or the Company's products in line with your service requests.
• To facilitate the provision or sale of credit products as per your requests.
• To advertise, market, or propose the Company’s products related to your transactions.
• To conduct financial transactions in compliance with the Company's contractual obligations.
• For research or studies.
• To create a database for analyzing and offering services or products of the Company and its subsidiaries.
• To improve product quality, services, and operations related to the Company’s business.
• To analyze and monitor the use of services via websites and for audit purposes in case of issues.
• To facilitate participation in the Company's activities.
• For purposes of access control, preventing and mitigating harm to life, body, or health of yourself or others, disease control, and ensuring safety within the Company's premises.
• To comply with applicable laws and regulations, both current and future.

The personal data collected for the above purposes is necessary for compliance with contracts or applicable laws. Failure to provide such necessary data may result in legal violations or hinder the Company’s ability to manage contracts or facilitate operations for you.

In case of any changes to the purposes of data collection, the Company will notify you and act in accordance with legal requirements, including maintaining records of amendments as evidence.

Consent for Service Usage

1. I hereby give my consent, as of the date specified in this document and continuing thereafter, including after the Personal Data Protection Act B.E. 2522 (1979) ("PDPA")comes into force, for the Company or individuals assigned by the Company, whether as data controllers, data processors, and/or data protection officers, to collect, process, use, and/or disclose sensitive personal data (hereinafter referred to as "My Personal Data"). This includes data appearing on my identification documents (e.g., national ID card, passport, or any other government-issued documents), my biometric data,as well as recorded visual or audio data and information provided in my application or service request forms or any other documents prepared occasionally. 

         I voluntarily give my consent without coercion or inducement. I am aware that I may withdraw this consent at any time, except in cases where limitations apply under the law or where the withdrawal would impact the Company's legal rights. Such withdrawal will not affect the collection, use, disclosure, or processing of data already completed. I may withdraw my consent through the channels specified by the Company.

2. I agree and acknowledge that I have registered my personal data and sensitive personal data, such as name, address, financial data, biometric data (e.g., fingerprint scans, facial recognition data), through the electronic system designated by the Company for the purpose of requesting products or transactions. I agree to comply fully with the Company’s terms and conditions for using its electronic system.

3. I confirm that all personal and sensitive personal data provided by me, whether about myself or others, is accurate, up-to-date, complete, and truthful. I declare that I provided such information while being fully conscious and not under any coercion. If my personal data change, I agree to notify the Company to update and correct the information accordingly.

4. I consent to the Company and/or its authorized representatives collecting, using, disclosing, and processing my personal data, including sensitive personal data, provided to the Company. This includes data registered for credit services through the Company’s electronic system or other credit services, whether currently or in the future, for the purpose of providing credit services in accordance with the rules approved by the Bank of Thailand.

5. I consent to the Company requesting, inquiring, verifying, tracking, and using my personal data for the purpose of facilitating my credit service usage. My consent regarding the collection, use, disclosure, and processing of my personal data under this document shall remain effective throughout the duration of my credit service usage unless withdrawn as specified in Clause 1.

6. I agree and acknowledge that submitting false information into the Company's computer system is a criminal offense punishable by law.

I have read, acknowledged, and agreed to provide consent for the disclosure of my personal data as detailed above.

I certify that the personal data provided in my registration to the Company is accurate, up-to-date, complete, and truthful. If such data prove to be false, I agree to allow the Company or relevant agencies to reject, revoke, or suspend my credit services or compensate for any damages incurred, as applicable. This shall not prejudice the Company’s rights to pursue legal action.
